Poppi settles $8.9 Million false ad lawsuit in California – consumers can file claims

CALIFORNIA – VNGR Beverage, LLC, maker of Poppi drinks, has agreed to an $8.9 million class action settlement resolving claims the “prebiotic soda” didn’t deliver its promised gut health benefits.

The settlement, filed in the United States District Court for the Northern District of California, is currently accepting claims until September 26, 2025.

Plaintiffs believed drinks contained prebiotics that would support gut health

Plaintiffs Kristin Cobbs, Sarah Coleman and Megan Wheeler stated in the court document that they purchased Poppi products for personal use on multiple occasions. They relied on Poppi’s labels claiming it was “Prebiotic Soda” made “For a Healthy Gut.” 

They believed the drinks contained prebiotics that would improve gut health and based their purchases on those claims.

However, the plaintiffs contend the products did not contain sufficient “prebiotics” to provide any meaningful “gut health” benefits.

Consumers would need to drink more than 4 Poppi sodas a day for health benefits

According to the plaintiffs, Poppi soda only contains two grams of fiber, an amount too low to cause any meaningful gut health benefits.

“… a consumer would need to drink more than four Poppi Sodas in a day to realize any potential gut health benefits from Poppi’s prebiotic fiber. However, even if a consumer were to do that, Poppi’s high sugar content would offset most, if not all, of those gut health benefits,” the plaintiffs argue.

They also argue that Poppi’s main prebiotic, agave insulin, is less effective for gut health and linked to side effects like bloating, abdominal pain, and potential liver damage.

The plaintiffs say Poppi’s prebiotic claims violate FDA regulations and that they wouldn’t have bought the products if they knew the truth.

Consumers can submit a claim

All U.S consumers who purchased any flavor or size of Poppi drinks for personal use between January 23, 2020 and July 18, 2025 have until September 26, 2025 to file a claim.

Consumers can receive up to 75 cents per can or maximum of $16 per household without proof of purchase. 

A minimum payout of $5 per household is guaranteed for valid claims.
